Brazil: Homosexual Inmates Granted Right to Conjugal Visits

(July 6, 2011) In June 2011, the Brazilian National Council on Criminal and Prison Policy (Conselho Nacional de Política Criminal e Penitenciária) issued an administrative act (resolução) granting homosexual inmates the right to have conjugal visits. The new act revokes the previous Administrative Act of March 1999 that did not include homosexual relationships for conjugal visit purposes.

Pursuant to the new act, the right to conjugal visits is also guaranteed to all incarcerated persons who are married or part of a stable union, including homosexual relationships. Therefore, starting Monday, July 4, 2011, all Brazilian prison wards must guarantee to all homosexual inmates the right to have a conjugal visit once a month.
