Brazil: Proposal for an Internet Law Soon to Be Launched

(Apr. 8, 2010) The Ministry of Justice will soon launch a draft proposal for a law that would regulate the use of the Internet in Brazil. The proposal is designed to define responsibilities for website contents, as well as rights and duties of all participants, especially when there is doubt regarding the source of the information.

According to the proposal, in case of a supported complaint made by a person or company injured by the information, the servers hosting the website containing the information must immediately suspend the posting of the information and notify the author. The information may be republished online if the author takes full responsibility for the information, which in turn exempts the server from responsibility in case of a judicial procedure.
