(Nov 25, 2008) Law No. 29259, promulgated by Peru's President Alan Garcia Perez on September 13, 2008, amends articles 24 and 26 of Law No. 27181, the General Law on Transportation and Ground Transit of Peru. The amended article 24.2 deals with administrative liability for violations of the Law. The owner of a vehicle and, if applicable, the provider of transportation services, are jointly responsible before the administrative authority for violations related to the technical condition of the vehicle, including violations of norms on labor conditions of transportation service workers and on protection of the environment and public safety.
Article 26.1 deals with sanctions and preventive measures related to violations of norms of transportation and ground transit. Applicable sanctions include: warnings to the company; imposition of fines on the company and the driver; suspension of a driver's license; disqualification to provide transportation service or perform activities related to transportation and ground transit; and termination of a driver's license and disqualification of the driver. Preventive measures include: withholding of the license for the driver and the vehicle; removal of the vehicle; temporary closure of the place of business; and precautionary suspension of service, among others.
