- - Caption label from exhibit Drawing Justice: Court Reporters Work Next to a Pile of Transcripts. "The first time I found out about the break-in," Daniel Ellsberg later said, "was when government prosecutors revealed it to the judge, and he told my lawyers." As evidence emerged indicating White House involvement in the break-in, grounds for a mistrial grew. On May 11, 1973, the judge granted the defense's motion for a mistrial citing government misconduct and dismissed all charges." As Judge Matthew Byrne declared a mistrial he said, "We may have been given only a glimpse of what this special unit did." The truth of his statement was confirmed as investigations into the Watergate break-in developed.
