Article France: Decree on Flag Desecration

(Sept. 20, 2010) France's Decree 2010-835 of July 21, 2010, on the offense of desecration of the national flag, prescribes that, in addition to the cases covered by article 433-5-1 of the Criminal Code, the desecration of the flag is punishable with a fine of €1,500 (about US$1,900). The decree covers the destruction, damage or use of the flag in a degrading manner in a public place. In addition, the showing by the perpetrator of the recording of such acts, even if committed in a private place, is punishable with the same fine. Article 433-5-1, which was inserted in the Criminal Code by the 2003 Law on Internal Security, provides that the act of publicly desecrating the national anthem or the national flag during an event organized or regulated by public authorities is punishable with a €7,500 fine (about US$9,500). If committed during a meeting or gathering, the offense carries a punishment of up to six months of imprisonment as well as the €7,500 fine.
