Article Brazil: State of Rio de Janeiro Mandates Reporting by Condominium Managers of Domestic Violence

(Oct. 2, 2020) On September 18, 2020, the governor of the state of Rio de Janeiro sanctioned Law No. 9,014, which provides that instances or evidence of domestic violence against women, children, adolescents, people with disabilities, or elderly people, in condominium units must be communicated to the condominium managers (síndicos) or other condominium administrators, who must immediately contact the police or other appropriate authority. (Law No. 9,014, art. 1.)

Instances of violence against children or adolescents must be sent to the appropriate Guardianship Council (Conselho Tutelar), with a view to protecting possible victims, without prejudice to also reporting to other authorities. (Id. art. 1(sole para.).)

A report to the condominium authority must be made by telephone or in person in cases of an ongoing occurrence, or in writing in other cases, within 24 hours after the fact is known. The person making a report to the authority must provide information that can help identify the victim and the aggressor. (Id. art. 2.)

Law No. 9,014 authorizes the creation of internal means of reporting by condominium authorities so they may receive complaints about domestic violence that occur in their units or common areas. Such reporting systems must guarantee, when necessary or requested, the anonymity of the resident making the report. (Id. art. 3.)
