Article Italy: Penalty System for Violation of Food Safety Regulations Redesigned

On May 23, 2021, Law No. 71 of 2021, which converted into law, with amendments, Decree-Law No. 42 of March 22, 2021 concerning penalties for food safety violations, entered into effect in Italy.

The new law redesigns the penalty system for first-time violators of agrifood and food safety legislation, which are currently sanctioned with pecuniary administrative penalties. The law establishes that in the case of remediable violations, the respective authority must warn the interested party to comply with the violated prescriptions within 30 days from the date of notification of the administrative offense, and eliminate its harmful or dangerous effects.

Remediable violations are defined as errors and formal omissions involving a simple regularization operation, or violations whose harmful or dangerous effects can be eliminated.

In the event that the violator fails to comply with the mandates contained in the notice of violation within the established term, the respective authority must file a complaint against the violator in accordance with current legislation.

The aforementioned formal notification procedure does not apply when noncompliant products have already been placed on the market, even if only partially, in which case stricter sanctions are imposed in accordance with applicable legislation.
