Article Brazil: National Public Safety and Social Defense Plan Enacted

On September 28, 2021, Brazilian President Jair Bolsonaro issued Decree No. 10,822, establishing the National Public Safety and Social Defense Plan (PNSP) 2021–2030 in Brazil. (Decreto No. 10.822, de 28 de setembro de 2021.) The plan, which will be in effect for 10 years, consists of objectives, strategic actions, goals, a governance system, and guidelines for federative entities. (Decree No. 10,822, art. 1.)

The plan’s four main objectives are defining strategic actions, goals, and indicators; determining monitoring and evaluation cycles; setting strategies for risk management; and providing guidance to federative entities. (Art. 2.)

In addition to its main objectives, the plan outlines 13 main goals. These goals include addressing violent deaths, protecting public safety professionals, changing aspects of the prison system, and taking actions to prevent disasters or accidents. (Annex.) Goals will be measured and monitored through the use of information and data from various national information systems. (Art. 5.) The Ministry of Justice and Public Safety is also tasked with working with federative entities to include local characteristics in goal setting. (Art. 5(§ 2).) This allows for public-safety policies at the state, district, and municipal levels to define goals that align with their local contexts. (Art. 5(§ 3).)

To meet its goals, the PNSP outlines 12 strategic actions for implementation. Identified strategic actions include:

  • Strategic Action 7, which focuses on increasing information sharing across public-safety organizations and the use of machine learning to analyze data pertaining to public safety and social defense.
  • Strategic Action 12, which focuses on developing and supporting actions by other private and public sectors that prevent or suppress crimes, such as human trafficking and disappearances, against vulnerable groups. (Annex.)

Additional proposals for strategic actions should include details on the responsible organization, implementation timeline, and alignment to PNSP goals and objectives. (Art. 3.)

These goals, objectives, and strategic actions will undergo annual evaluations. The Ministry of Justice and Public Safety is responsible for monitoring the progress on indicators, strategic actions, and goals. (Art. 6.) Along with federative entities, the Ministry of Justice and Public Safety will annually evaluate the plan’s implementation and provide recommendations to bodies implementing public safety and social defense policies. (Art. 8(§ 1).)

The PNSP also states that social participation will be part of the plan’s governance. (Art. 7.) Similarly, in announcing the plan, the government of Brazil mentioned how the review period for the plan included a public consultation process during which members of the public and public agencies made 1,400 contributions with emphasis on public security institutions.
