-  Summary: Miller purchased two tracts of land, one of forty acres and the other of eight acres, from Abram Freeman and Clarkson Freeman, partners in A. Freeman and Company, for $625. Miller gave Freeman and Freeman a promissory note for the amount and promised to pay in whiskey--1,250 gallons, or 35 barrels, at $0.50 per gallon. Freeman and Freeman agreed to convey the deed upon full payment. Miller retained Logan and Lincoln and sued Freeman and Freeman to obtain the deed. Miller claimed that he had paid the note, and he asked the court to order Freeman and Freeman to convey the deed. The court ruled for Miller, and ordered Freeman and Freeman to convey the deed after Miller paid the $39.07 balance due on the note and $34.15 due on an earlier judgment against Miller. Miller failed to pay the judgment, and the court later ordered him to pay the $73.22 within thirty days or suffer the cancellation of the contract. The court eventually removed the case from the docket without recording a final resolution.
