  • -  Summary: Gipson sued C. B. Guard and James L. Guard in the JP court to recover a debt of $31.82. Guard and Guard claimed a set-off, and the JP ruled for Guard and Guard. Gipson, who was a resident of Edgar County, Illinois, did not realize that the court had heard the case until after the judgment. Gipson claimed that Guard and Guard had agreed that if they could not pay, they would give a new promissory note to Sprigg, on behalf of Gipson, or they would not defend against Gipson's lawsuit before the JP. Gipson retained Lincoln and Herndon and appealed the judgment to the circuit court and requested a writ of certiorari. The court issued a writ of certiorari, later dismissed it, and then issued a writ of procedendo to the JP court.
