Brazil: Municipal Elections Postponed Because of COVID-19

(July 7, 2020) On July 2, 2020, the Brazilian Congress promulgated Constitutional Amendment No. 107, which determines that the first round of the municipal elections scheduled for October 2020 will take place on November 15, 2020, and the second round, where applicable, will be held on November 29, 2020.

In the event that the sanitary conditions of a state or municipality do not allow for the holding of elections on the dates provided for above, article 1(ยง 4) of the amendment provides that the National Congress, at the request of the Superior Electoral Court and with the support of the national sanitary authority, may enact a legislative decree to designate new dates for the election, to be held by December 27, 2020. The legislative decree also requires the support of the joint commission created by article 2 of Legislative Decree No. 6 of March 20, 2020, to monitor the fiscal situation and the budgetary and financial execution of measures concerning the COVID-19 public health emergency. The amendment also tasks the Superior Electoral Court with providing the measures necessary to complete the electoral process.
