The Lieber Collection is the personal library of Brigadier General Guido Norman Lieber, Acting Judge Advocate General of the United States Army from 1884 to 1895 and Judge Advocate General from 1895 to 1901. BG Lieber was the youngest of three sons of Dr. Francis (Franz) Lieber (1798–1872), influential scholar and professor of international law, who is best known for his codification of the laws of war for a national army, commonly known as the “Lieber Code.” The Lieber Code was adopted by President Abraham Lincoln and issued on April 24, 1863 as General Orders No. 100.
The Lieber Collection includes the materials inherited from Dr. Lieber’s library, as well as BG Lieber’s acquisitions and publications. Three publications in geology written by Oscar Lieber, the oldest son of Dr. Lieber, are part of this personal library. BG Lieber’s daughter, Mrs. C. F. Stearns (Amelia Lieber), gave the collection as a gift to the U.S. Army Judge Advocate General’s Corps in 1947. Dr. Francis Lieber (1798/1800-1872)
Francis Lieber, a Prussian-born American political philosopher and public intellectual, was an internationally recognized authority on international and military law and a key legal advisor to the Lincoln administration during the Civil War. He is best known for crafting the earliest official government codification of the customary laws of war. The Lieber Code, as his text became known, was issued with Lincoln’s approval in 1863 as General Orders No. 100 under the title Instructions for the Government of Armies of the United States in the Field. Previously no such formal, comprehensive code existed to guide and constrain the behavior of troops in the field. Lieber’s Code for the Union became the basis for subsequent editions of the standard manual for U.S. forces on the laws of war and inspired similar manuals in many European nations. On the international level, the code substantially influenced the development of modern treaties on the conduct of war, including the later Hague and Geneva Conventions.
Guido Norman Lieber, a U.S. Army brigadier general who retired as Judge Advocate General in 1901, headed the Judge Advocate General’s Department for 16 years. His tenure in that role remains the longest in Army history. BG Lieber is best known as the author of a number of influential treatises on military law, including The Use of the Army in Aid of the Civil Power (1898) and Remarks on the Army Regulations (1898). He also worked to ensure the continuing influence of the code that his father, Dr. Francis Lieber, wrote in 1863 for Lincoln and the Union Army on the rules of conduct in war. As the Spanish-American War began in 1898, BG Lieber published and distributed a pocket edition of that 1863 code, General Orders No. 100.
Oscar M. Lieber (1830–1962)
Oscar Montgomery Lieber was an American geologist, who wrote several popular practical guides in mineralogy and chemistry. He was a son of Prussian-born jurist Dr. Francis Lieber, the Lincoln adminstration’s principal adviser on legal questions regarding the rules of conduct in war. Oscar succumbed at age 32 to wounds sustained as a Confederate soldier.
Alfred Hamilton Lieber, called Hamilton, was the second of three sons of Dr. Francis (Franz) Lieber (1798–1872), a German–American jurist best known for his codification of the laws of war at the behest of the Lincoln administration. Hamilton was also the brother of Brigadier General Guido Norman Lieber, to this day the longest-serving head of the U.S. Army’s Judge Advocate General’s Department (1884–1901). Hamilton shared with his father and both brothers the experience of combat service in war. He differed from them in not taking up the role of writer/scholar. Hamilton was appointed to the U.S. Naval Academy but left after the first year to become a farmer. In 1861, he joined the Illinois militia to fight for the Union in the Civil War. His younger brother Norman also served in the Union Army, while his older brother, Oscar, served and was killed as a Confederate soldier. In 1862, shortly before Oscar was mortally wounded, Hamilton lost an arm at Fort Donelson. Subsequently, General Halleck appointed him to his staff and made him a captain. After the war, Secretary of War Stanton made Hamilton a lieutenant colonel. On October 18, 1876, he died in Baden-Baden, Germany, where he was seeking medical treatment for wounds suffered in the Civil War.
