Rights and Restrictions Information

Prints and Photographs Division, Library of Congress, Washington, D.C., 20540-4730

There are no known restrictions on work taken by staff photographers. Other material may be restricted by copyright. In addition, the rights of privacy and publicity may apply.

Access: Permitted, subject to P&P policy on serving originals.

Reproduction (photocopying, hand-held camera copying, photoduplication and other forms of copying allowed by "fair use"): Permitted; subject to P&P copying policies.

Publication and other forms of distribution: Per the deed of gift, the U.S. News & World Report, Inc., dedicated to the public all rights it held for the photographs in this collection upon its donation to the Library. The majority of the photographs in this collection were done for hire by U.S. News & World Report staff photographers, primarily Warren K. Leffler, Thomas J. O'Halloran, Marion S. Trikosko, John Bledsoe, and Chick Harrity identified on photographic captions by their initials --WKL, TOH, MST, JTB, and CWH. A few photographs from the 1950s were taken by Mary Dean. There are no known restrictions on their photographs. Copyrights to photographs in the collection that were not produced as "work for hire" by U.S. News & World Report staff photographers may be retained by the photographer or his/her heirs. Neither the donor nor the Library has been able to satisfactorily establish which works are in this category. Therefore, the Library recommends that patrons obtain permission from the creator agency, the photographer or the photographer's heirs before publishing or otherwise distributing images taken by non-staff photographers, except as allowed under "fair use." The addresses of such parties, and an indication of the status of their works (to the extent known by the Library) are provided in the Restrictions Notebook under the photographer/agency name. In addition, the rights of privacy and publicity may apply.
