NAME: Open Access and License Information in the MARC 21 Bibliographic and Holdings Formats

SUMMARY: This paper explores ways on how to reflect open access and license information in the MARC 21 Bibliographic and Holdings formats. It analyzes the existing fields 506 (Restrictions on Access Note), 007 (Electronic Resource), 008 (Fixed-Length Data Elements), 540 (Terms Governing Use and Reproduction Note) and 856 (Electronic Location and Access) and makes suggestions for extensions to cover needs identified by the German speaking part of the MARC community, in cooperation with OCLC.

06/24/18 – Results of MARC Advisory Committee discussion: MAC expressed understanding of the desire to record open access details in a variety of ways. Most participants felt that the 007/008 field approach had too many limitations. It was clarified that the recording of open access details is applicable to both the Bibliographic and to the Holdings level. Further discussion of a mixed access value 2 was carried over from 2018-DP10 with no resolution for the time being.While a general revision of field 856 was estimated as helpful, this process should not delay the resolution of the open access issue. The paper will return as a proposal, in coordination with the substance of 2018-DP10.
For online publications it is important to know whether a given resource is available "free to read", as defined e.g. in NISO RP-22-2015 "Access and License Indicators" at http://www.niso.org/publications/niso-rp-22-2015-access-and-license-indicators. A designation of open access provides similar information.
After access has been provided, a user should be able to get information on what use rights are connected to the online resource. There is a large variety of rights and of ways to express them. Creative Commons and Rights Statements are initiatives which have created vocabularies for this information.
On behalf of libraries in German speaking countries, the Committee on Data Formats ("Fachgruppe Datenformate") has formed a subgroup, the Working Group on Licenses ("Themengruppe Lizenzangaben") in 2016. To improve ways on how to express open access and license information in MARC 21, the Working Group has defined its scope, identified needs and analyzed existing elements in MARC 21, and is working on best practice recommendations. A liaison to a second Working Group with other metadata standards in scope has been established.
To focus its work, only information about global, context free access conditions and restrictions are in scope, e.g. the designation that a resource is free to read or available under open access conditions, and usable and reusable under specific conditions, e.g. Creative Commons or Rights Statements.
License information about a publisher or vendor providing a customer or a group of customers access to a single resource or a package of resources under certain conditions, controlled by different technical means, will not be dealt with in this paper.
Discussion Paper 2018-DP06 and Proposal No. 2018-04, "Versions of Resources in the MARC 21 Bibliographic Format", have some relationship to these efforts: Distinguishing between different versions of a resource is important when a library intends to hold a variety of versions, and may make it easier for an end user to select a version which is "good enough" and openly available.
Several fields have been identified for closer analysis: field 506 (Restrictions on Access Note), containing "information about restrictions imposed on access to the described materials"; field 540 (Terms Governing Use and Reproduction Note), containing "terms governing the use of the materials after access has been provided"; field 856 (Electronic Location and Access) when similar information should be given in the context of a URL; and fields 007 / 008 when core information should be given as a code in a fixed field.
Field 506 (Restrictions on Access Note) has a first indicator "Restriction", with the defined values:

We are reading 506 indicator 1 value "0" as an equivalent to what is now called "open access", and "free_to_read” from NISO RP-22-2015 "Access and License Indicators". To document this way of understanding and usage, the definitions can be enriched, using more positive wording (our additions in bold):
0 - No restrictions
Field affirms an absence of access restrictions, e.g. open access1 - Restrictions apply
Field defines access restrictions to some or all of the material described, e.g. restricted or closed access
Alternatively, the names of the indicator values themselves may be enriched:

1 - Restrictions apply, restricted access
With the information that "for continuing resources, the restrictions must apply to all issues", we see the need for an additional indicator value, e.g. "2", for "Restrictions apply in part", so that a continuing resource that consists of a mixture of issues or articles, some under open access conditions and others under closed access conditions, can be marked if no other information is available. This is sometimes described as "hybrid open access". If more detailed information is available, subfield $3 (Materials specified) may contain information about which of the parts fall into which category, expressed in repeatable fields 506.
In field 506, the following subfields are defined:

Chronological information plays a role in licensing information. Some examples in the MARC documentation of field 506 already contain embargo information, or an "opening date", e.g.

Here we are considering a more specific way to express embargo information, i.e. a date when the resource becomes freely available, by defining a new subfield "$g" for an "opening date". This subfield should be able to support technical solutions to switch from "closed" to "open" as soon as the point in time expressed in the subfield has been reached.
Information may not always be valid or reliable. To express the source of information given in the field as a whole, an additional subfield "$q" for an "assigning agency" should be defined, containing a MARC Organization Code / ISIL or the textual name of the organization or project.
A more prominent way of designating access conditions than the first indicator of field 506 would be a code in one of the fixed fields. Instead of having to create a note field, with information in its subfield(s), a code can be provided by a cataloger or by a machine process indicating that the resource is either freely available, not freely available, or freely available only in part.
Analyzing the coded fields, field 008 (Fixed-Length Data Elements) seems to be an option. Across all types of material, position 32 is currently undefined.
If the information pertains to electronic resources (and their subset, the online resources) exclusively, field 007 (Electronic Resource) with position 00 (Category of material) value "c" for "Electronic resource" would be a similar option, where until now position 02 is undefined.
Either field 008 position 32, or field 007c position 02 may be defined as follows:

It has to be noted that here the values "0" and "1" are designed according to regulations in most programming languages, where "0" is "false" and "1" is "true". By this approach the values "0" and "1" of field 506 first indicator are flipped in their meanings, because field 506 provides information on restrictions.
Field 540 (Terms Governing Use and Reproduction Note) has less subfields than field 506:

In 2006, field 506 has evolved by adding subfields $f (Standardized terminology for access restriction) and $2 (Source of term), so that it can carry data from controlled vocabularies, such as "star" for the "Standardized terminology for access restriction". Field 540 needs the same structure, so that information e.g. taken from the list of Creative Commons licenses, or from the RightsStatements terminology, can be carried in a more-than-textual way: Subfield $f (Standardized terminology for use and reproduction rights) and subfield $2 (Source) should be defined. The same existing MARC code list for Access Restriction Term Source Codes can then be used for both field 506 and field 540.
The additional subfields discussed for field 506, "$g" for an "opening date" and "$q" for an "assigning agency" should be carried over to field 540 as well.
If an attribution, the naming of a copyright holder, is mandatory, the information can be given either in a 100, 110, 111, 700, 710, 711 or 720 field with the relator code "cph", or field 542 (Information Relating to Copyright Status) can be used.
Field 856 (Electronic Location and Access) may contain license information, too. It is defined as follows:

Some implementations use records in a condensed form, so that a printed resource and its digitized equivalent are described in only one record, or different online versions of a resource share a common MARC 21 record. In these and similar cases, information about online access is given in repeated 856 fields with a URL in it. As the information about the respective access conditions and use rights can differ between the different online versions, it can not be given on the level of the resource itself, so fields 506 and 540 are not an option.
As Roy Tennant puts it in his blog post from October 15, 2017 "'MARC Must Die' 15 Years On" at https://hangingtogether.org/?p=6221 : "[...] how does one specify in MARC that a given URL will take someone to the openly available full-text of an item? That seems like a laughably simple thing to do and also very important, but there is no way for us to assert this unambiguously in a form that computers can easily use."
The information has to be provided in the context of field 856. Both indicator positions in field 856 are already defined, for "access method" and for "relationship", neither one of these is useful to add information about open access vs. closed access.
A solution with pairs of fields (506/856) brought together by subfields $8 (Field link and sequence number) may be discussed; here however the level of complexity becomes a higher one, and there is a risk of misinterpreting data: A field 506 linked to a field 856 with subfields $8 may be misunderstood, leading to false conclusions.
Here, $7 (Control subfield) may be an option worth exploring: $7 is not yet defined in 856. Generally speaking, $7 is defined in a few fields to hold information in coded form, reflecting information that is defined in parallel at another place of the format. So, subfield $7 may be used to provide an equivalent to the codes discussed for field 008 position 32 or field 007 position 02:

If no information can be provided, subfield $7 should be omitted from field 856. The definition of further values at position /0 and of further positions may be needed.
To provide additional information as an equivalent to fields 506 and 540 in field 856, none of the existing subfields seems to fit. One option worth exploring is the definition of a new subfield. According to the documentation, "subfield $g (Electronic name - End of range) was rarely, if ever, used. It was redefined as Uniform Resource Name in 1997, and was subsequently made obsolete in favor of recording the URN in subfield $u". Re-using $g may cause conflicts in legacy data.
Thus, "$e" is the last available subfield code. We suggest exploring the definition of $e in field 856 as an equivalent to 506 $a, $f and $u, and of 540 $a, $f (to be defined, see above) and $u. A name for $e would then be "Information governing access, use and reproduction" or similar. In the definition it should be made clear that either a free-text term or a standardized term or a URL can be used.
In field 856, subfield $2 is already defined for an "access method", i.e. a code from the Electronic Access Methods Code List, in this case an extension to the values of the first indicator "access method". As a result, subfield $2 unfortunately cannot be used to set the context of the field, namely of the proposed $e, forming an equivalent to 506 $2 and 540 $2 (to be defined, see above). A possible way may be adding a position /1 to subfield $7:

Some information regarding access, its restrictions, use rights etc. have to be handled on the local level, in addition to the bibliographic level. For example, an online resource is made available under open access conditions by a publisher, but the German National Library is not allowed to provide open access to the archived online copy on the DNB server, as the publisher is interested in controlling access of his publications via his own web site. As a consequence, we are planning to have each of the existing fields, including the extensions discussed here in this paper, both in the Bibliographic and in the Holdings format.
